So This Is What They Call Justice
The recent Supreme Court ruling here in the UK that only CIS women (i.e. assigned female at birth) are women in the eyes of the law, meaning that Trans-Women irrespective of whether they have a Gender Recognition Certificate, have female on their passport and driving license are no longer women in legal terms. Even a Trans -Woman who has medically transitioned are not regarded as women.... How can this be right?
The sight of seeing two women jumping for joy outside the Supreme Court made me feel sick, I don't know what they think they have achieved or what the real reason for the legal challenge was, but one thing is for certain it was not Justice... According to the Oxford English Dictionary justice is defined as "A concern for justice, peace and a general respect for people" In this case (in my opinion) justice and respect has been ignored. The people bringing this challenge and the Supreme Court itself has not only inflected untold damage on the rights of Trans-Women, but also put CIS women under more scrutiny than ever before. Last year the Scottish Police sent a CIS women to a male prison because she looked to be trans gender (under Scottish law people who are sent to prison will go to one in line with their sex assigned at birth). So if businesses, institutions etc are forced to put into place rules as to who can use certain area's not only with Trans-Women be subject to scrutiny but so will many women.....
The women jumping for joy outside the Supreme Court should also consider this, if Trans-Women are banned from using female places then Trans-Men will be banned form male places, because if they are not then there would be a clear case of discrimination.... I would advise those two women to take a look at Buck Angel, (Google him there are plenty of photos on the net), then ask themselves the question "Would you be happy to have someone looking like him in female only places?" I use Buck Angel as an example because he has not had gender affirming surgery and so is still female, not only in the eyes of the UK law, but also physically...........
Obviously this is a very difficult subject to consider, female safe spaces, trans athlete's etc and there are pro's and cons on all sides, but we need a sensible conversation, there does need to be certain rules and it will be an almost impossible task to please everybody. In fact I doubt if that will ever be the case, but instead of coming to the table looking for confrontation and a 'win' the various parties need to show respect, we (Trans - Gender) have just as much right to be here as anybody else. This court case will not make us go away, quite the opposite.....
I have to say I am so pleased with the support the Trans - Community has received from others, outside our community, we really do appreciate those that have turned out to support us. The fact is we have always been here, in almost every country in the world, we have been discriminated against and abused for centuries, but we are still here, we always will be, the sooner the 'haters' realise we are not going anywhere and engage in meaningful conversations the better....
One final thought, I never do political comments here, but on this occasion, I will make an exception, in the UK there are a number of local elections taking place, firstly please do use your vote, it is important, secondly look at who you are voting for and choose a candidate that supports the Trans - Community we need to show those in authority our vote matters....
I hope you're coping with the news around this.
ReplyDeleteI'm not sure I can convey how much damage this badly thought out decision is causing.
If this was about any other protected characteristic, it would be a very different story.
Thank you as always for your comment Lynn, like everyone in our community I am struggling with this, but having said that we are very strong, we have had to be to survive many years of discrimination. But as always there is hope, the politicians as ever can't be trusted, they are only after votes and pursuing their own career, but I feel at least some of the public are behind us, so the fight must go on stronger than ever.....
DeleteOur biggest problem is the older generations, people now into their 50's and above I think, many of them still have the thinking of years gone past when being homosexual was illegal, when it was 'acceptable' to use abusive language to minority groups, when sexist 'jokes' were apparently acceptable. They hark back to the the time when everything was calm and on their terms, now it is not and the tide is forever turning, they see their vision of how life should be slipping away. The sight on a recent post of J K Rowling smoking a cigar on her £115K super yacht celebrating the Supreme Court's decision somewhat disturbing, prompting the question 'What (from her perspective) is this really all about?....
